Migration Rules - 1. Customers may terminate the BT Business Plan (CR) Contract and migrate to any BT package of a greater Minimum Committed Call Spend value and Contract Period without being subject to the BT Business Plan (CR) Reconciliation rules.
- 2. Any other migration or cessation will be subject to the reconciliation rules laid out below.
- 3. The original Contract will be terminated and a new Contract Period commenced. The new Contract will be for a full Contract Period and spend under the ceased Contract Period will not count towards the Committed Call Spend for the new Contract Period.

End of Contract Period Credit - 1. If the Customer's Total Contributory Call Spend exceeds £500 at the end of the Contract Period at the specified Site, BT will credit a Customer's bill after the Spend Measurement Date with a sum equal to 5% of the Eligible & Contributory Call Spend.
- 2. For lines with Inclusive Call Allowances, the actual Call Spend (in accordance with Tables 3 and 4 above) will contribute to the Total Contributory Call Spend at the BT Business Plan (CR) Rates.

Reconciliation: |
For all contracts with a Spend Measurement Date after 1st April 2004, BT will allow a 10% tolerance on Customers' Committed Call Spend to allow for the effect of price reductions during the expired Contract Period. This means that if the Customer's Total Contributory Call Spend is at least 90% of the Committed Call Spend, no reconciliation charges will apply. - 1. If the Customer's Total Contributory Call Spend is less than 90% of the £500 Committed Call Spend on the Spend Measurement Date at a specified Site, the Customer will be charged on a bill after the Spend Measurement Date, a reconciliation payment equal to the difference between the Adjusted Committed Call Spend and their Total Contributory Call Spend.
- 2. If the Customer terminates BT Business Plan (CR) at a Site before the end of the Contract Period applicable to the Site and before reaching the Adjusted Committed Call Spend, then the Customer will be billed a reconciliation charge equal to the difference between the Adjusted Committed Call Spend and their Total Contributory Call Spend.
- 3. This will be invoiced after cessation of the Contract.
- 4. Customers may terminate the BT Business Plan (CR) Contract and migrate to BT Business Plan or any of the other BT Commitment packages of an equal or greater Committed Call Spend value without being subject to the BT Business Plan (CR) reconciliation rules.
- 5. When a BT Business Plan (CR) Customer moves Site (which means totally ceasing one Site and relocating to a new Site), the Customer may transfer the package from the ceased Site to the new Site without incurring a reconciliation charge, so long as the Customer does not have an existing BT Business Plan (CR) (or BT Business Plan) package applying at the new Site. The transfer date of the BT Business Plan (CR) package will be a date within a period of 28 days from the date that the Customer relocates to the new Site, as agreed between the Customer and BT. Partial Site moves will be subject to the BT Business Plan (CR) Reconciliation rules.

A Site move is defined as: a Customer totally ceasing one Site and re-locating to a new Site, where the new Site has been in operation for no more than 28 days and does not already have the BT Business Plan (CR) package. Partial Site moves will be subject to the BT Business Plan (CR) reconciliation rules. |
